It is absolutely essential for you as a relying party (Relying Party) to read and agree with the following terms and conditions before validating a Digital Certificate or accessing Certificates Revocation List (CRL) issued by Comtrust. If the terms and conditions (Relying Party Agreement) contained herein are not agreed and accepted, you are not therefore authorized to use the aforementioned resources of Comtrust.

1. Effectiveness & Responsibilities
This Relying Party’s Agreement shall become effective when any person (Relying Party) submits a query to search for a Digital Certificate or to undertake validation of digital signatures created with a private key corresponding to a public key contained in a certificate, or when the Relying Party otherwise use or rely upon information or services provided by
Comtrust.
2. Knowledge of Information
The Relying Party acknowledges that he has sufficient knowledge and information enabling him to decide the extent to which he may rely on the Information in a Certificate.
3. Comtrust CPS
The Relying Party acknowledges and agrees that Comtrust Certification Practice Statement (CPS), as amended from time to time, shall govern his reliance on Digital Certificates. The CPS or any amendments thereto is published in Comtrust Repository at
http://www.comtrust.co.as/repository/cps.
4. Disclaimer of Warranties
Except as expressly provided in paragraph 2.21 of Comtrust CPS, Comtrust disclaim all warranties and obligations of every type, including any warranty of merchantability or fitness for a particular purpose or warranty for the accuracy of information provided.
5. Limitation of liability
5.1 Subject to Section 2.2 of Comtrust CPS, in no event shall the aggregate liability of Comtrust under this Agreement to relying parties or any other third party exceed the applicable liability limits for such certificate set-forth below. The combined aggregate liability of Comtrust concerning a specific certificate shall be limited to an amount not to exceed the following:

5.2 Notwithstanding Sub-clause 5.1 above, in no event shall Comtrust be liable for any indirect, special, incidental and consequential damages, or for any loss of profit, loss of data or other indirect, consequential or punitive damages arising from or in connection with use, delivery, license, performance, non performance or unavailability of certificates or digital signatures
5.3 Comtrust shall not be liable for any damages caused, if digital certificate or private key is used for purposes that are not consistent with certificate usage as defined in CPS. Comtrust shall in no event be liable for any damages suffered by a relying party, if the Relying Party has not acted in a manner consistent with Section 2.1.4 of CPS.
6. Severability
If any of the responsibilities of the Relying Party stated hereabove or any term of this Agreement, is for any reason and to any extent become invalid or unenforceable, the reminder of these responsibilities or the terms of the Agreement shall not be affected by such invalidity or unenforceability and shall be interpreted in a manner that reasonably carry out the intent of the parties involved.
7. Warning of Theft or Forgery
The Relying Party is hereby notified of the possibility of theft or other form of compromise of private key corresponding to a public key contained in a digital certificate, which may or may not be detected and the possibility of use of a stolen or compromised key to forge a digital signature to a document. The possession and safeguard of private key from theft and compromise is sole responsibility of the certificate owner.
8. Acceptance of the Agreement & CPS
The Relying Party hereby demonstrates his knowledge and acceptance of the terms of this Agreement and Comtrust CPS whenever he submits a query to search for, or to verify the revocation status of a digital certificate or by otherwise using or relying upon any information or services provided by ComTrust.
In case the Relying Party does not agree to the terms of this Agreement or Comtrust CPS, the use of query or the validation of services is not authorized
9. Fore Majeure
Any delay or failure in performance by Comtrust under this Agreement shall not be considered a breach of this Agreement if and to the extend caused by events beyond the reasonable control of
Comtrust, including but not limited to, acts of God, governmental restrictions, strikes or war.
10. Governing Law & Jurisdiction
This Agreement, and the interpretation of it, shall be governed by the laws of the United Arab Emirates and the Relying Party hereby agree to submit to the exclusive jurisdiction of United Arab Emirates courts.
